Freedom of speech on platforms: Lessons to be learned from copyright law

It is not easy to strike a balance between the protection of intellectual property or personal rights and freedom of expression, especially on online platforms. Copyright law had to learn this the hard way when the EU introduced Art. 17 CDSM Directive. It was immediately the subject of an annulment action before the CJEU, which gave strict instructions to implement safeguards to reconcile copyright protection with freedom of speech. The DSA has not been the subject of such controversy, although the same conflict exists. What lessons can be learned from copyright – and vice versa?
Professor Benjamin Raue holds the chair of private law, law of the information society and intellectual property law at Trier University and is managing director of the Digital Law Institute Trier (IRDT). He has specialised in copyright law, platform regulation and other questions of digital law. From 2022-2023 he was dean of the law faculty in Trier.
